    Environmental Regulation, Energy, and Market Entry

    As my contribution to a symposium, I was asked to identify and to discuss conflicts between environmental regulation and pursuit of the goals of national energy policy. I identify three contexts in which I see clear conflicts between environmental regulation and energy policy - gasoline production, importation of liquefied natural gas, and transmission of electricity. In each case, I conclude that the conflict is attributable to state and local regulations. In the case of the gasoline market, I conclude that the market is beginning to perform poorly because of a combination of state land use regulations that make it impossible to construct new refineries and state gasoline-type mandates that are in the process of transforming the highly competitive and efficient national gasoline market into scores of much smaller inefficient markets that are increasingly susceptible to both unilateral and collusive exercises of market power. In the case of the natural gas market, I conclude that state and local government attempts to assert the power to veto federally approved liquefied natural gas terminals place us in jeopardy of experiencing a devastating shortage of natural gas in the next few years. In the case of electricity transmission, I conclude that our rapidly growing shortage of transmission capacity is already costing us many billions of dollars per year and increasing dramatically our vulnerability to widespread blackouts and price spikes, and that the shortage is attributable primarily to state and local land use regulation. In each case, the conflict can be eliminated only by reducing the power of state and local regulators and/or by transferring some regulatory power from state and local institutions to federal institutions

    This Essay responds to Professor Steve Johnson’s Article for the 2014 Duke Law Journal Administrative Law Symposium, Reasoned Explanation and IRS Adjudication. I first describe the ways in which courts have added burdensome procedures that are not required by the APA for the notice and comment process. Next, I explain why the Office of Information and Regulatory Affairs (OIRA) is better than courts at reviewing the adequacy of agency reasons for issuing a rule. Finally, I explain how courts can eliminate judicial review for the adequacy of the reasons IRS gives for issuing a rule by applying the traditional broad interpretations of the Anti-Injunction Act and the tax exception to the Declaratory Judgment Act

    A three-dimensional turbulent separated flow and related mesurements

    The applicability of and the limits on the applicability of 11 near wall similarity laws characterizing three-dimensional turbulent boundary layer flows were determined. A direct force sensing local wall shear stress meter was used in both pressure-driven and shear-driven three-dimensional turbulent boundary layers, together with extensive mean velocity field and wall pressure field data. This resulted in a relatively large number of graphical comparisons of the predictive ability of 10 of these 11 similarity models relative to measured data over a wide range of flow conditions. Documentation of a complex, separated three-dimensional turbulent flow as a standard test case for evaluating the predictive ability of numerical codes solving such flows is presented

    Piloting decision aid for spacecraft proximity operations

    The concept of a decision aid to assist the piloting of a powered vehicle during a near-field (less than 2000 feet) rendezvous to another spacecraft is discussed. Using Space Shuttle rendezvous with an orbiting satellite as an example, extensive practice is normally required to successfully effect such a rendezvous with a minimum of propellant. As a rule, variations on a 'point and shoot' technique are optimized and used as much as possible. A piloting decision aid (PDA) to assist in the pointing process was conceived and is in the preliminary stages of development. This concept may be applied to Space Shuttle proximity operations for berthing with Space Station Freedom (SSF), for Shuttle rendezvous with other spacecraft, or for autonomous rendezvous of any unmanned vehicle with SSF. The concept orginated with a task order from NASA JSC for an automated piloting procedure and was influenced by an early air-to-air missile envelope display

    NIM and CAMAC module studies

    The feasibility of adapting two NIM and two CAMAC modules for space research was studied. Methods are outlined for reducing the power in each module by approximately fifty percent. Components that could not be replaced from the NASA approved component list are identified. Special problems associated with grounding, vacuum operation, temperature variations, vibration and shock are outlined. Suggested solutions for these problems are discussed

    Sfermion Interference in Neutralino Decays at the LHC

    If the two lightest neutralinos of the Minimal Supersymmetric Standard Model have a mass splitting less than the Z boson mass, interference effects in the three-body decay chi_2^0 --> chi_1^0 f f can be important. We formulate an observable that contains information on the nature of the interference: the ratio BR(chi_2^0 --> chi_1^0 b b) / BR(chi_2^0 --> chi_1^0 l+ l-). This will give a constraint on the supersymmetry breaking parameters that is complementary to many techniques already existing in the literature. We present some ideas on how to perform a simple counting experiment to determine this ratio.Comment: 14 pages, 6 figure

    An experiment in software reliability

    The results of a software reliability experiment conducted in a controlled laboratory setting are reported. The experiment was undertaken to gather data on software failures and is one in a series of experiments being pursued by the Fault Tolerant Systems Branch of NASA Langley Research Center to find a means of credibly performing reliability evaluations of flight control software. The experiment tests a small sample of implementations of radar tracking software having ultra-reliability requirements and uses n-version programming for error detection, and repetitive run modeling for failure and fault rate estimation. The experiment results agree with those of Nagel and Skrivan in that the program error rates suggest an approximate log-linear pattern and the individual faults occurred with significantly different error rates. Additional analysis of the experimental data raises new questions concerning the phenomenon of interacting faults. This phenomenon may provide one explanation for software reliability decay

    Evidence for Stellar Streaming in the Cores of Elliptical Galaxies: A Kinematic Signature of Mergers?

    We present evidence for non-Gaussian velocity fields within the cores of luminous elliptical galaxies. This evidence is based upon high signal-to-noise, medium-resolution spectroscopy of the cores of early-type members of the Virgo and Coma clusters obtained with the WIYN 3.5-m telescope. The Virgo data were acquired using an integral-field unit (DensePak) allowing the velocity field to be sampled over a variety of spatial scales. The Coma data were obtained through single, 2-arcsec diameter fibers. The cross-correlation profiles of luminous ellipticals show considerable structure, often having several features with amplitudes as high as 10% that of the cross-correlation peak itself. This structure is most obvious within a radius of 1.5 arcsec (at Virgo), or < 100 pc, and is nearly undetectable when the data are binned over R < 15 arcsec, or < 1 kpc. Similar features are found in the single-fiber spectra of the luminous ellipticals in the Coma Cluster suggesting they are ubiquitous to giant ellipticals. Interesting, only the most luminous elliptical galaxies show this phenomena; the central regions of lower luminosity ellipticals have regular, Gaussian-like profiles. We interpret this kinematic structure as ``stellar streaming'' and suggest that this phenomena could be a relic signature of the merger history of luminous elliptical galaxies.Comment: Latex, 5 pages, 2 figure
